The Economic and Financial Crimes Commission says it will appeal the ruling of the Federal High court sitting in Abuja stopping the commission from retrying the former governor of Abia State Orji Uzor Kalu.
Senator Kalu was serving a twelve year jail term for fraud to the tune of more than seven billion naira when the Supreme court nullified the proceedings leading to the conviction of the former governor.
The Apex court ordered a retrial at the federal high court but the former governor filed an application before the federal high court in Abuja seeking to stop his retrial.
Ruling on the application Justice Inyang Ekwo granted the senator’s request on the ground that that the apex court did not order the retrial of the ex governor.
The presiding judge held that by virtue of section 36 subsection 9 of the constitution a person can not be retried on the offense which he has been convicted.
